Update: Mother facing murder charges in the death of her baby released

According to our news partner, News10NBC, Christina Colantonio, 28, was released from custody because the Monroe County medical examiner is unable to determine if a live birth occurred.

Without that evidence, prosecutors say they cannot present the case to a grand jury and cannot hold Colantonio.

Prosecutors say, however, that the murder charge is still pending.

Batavia Police say Colantonio was charged with murdering her infant and keeping the baby's body in her apartment.

She was arraigned on murder charges for the intentional death of her baby on Saturday and is expected in court on Thursday.

Police say after she gave birth, Colantonio killed her baby girl and kept the infant's body for three months.

“This is a shock, this is really a shock,” said David Zanghi, neighbor.

According to our news partner, News10NBC, neighbors started to learn about what police say happened in the apartment next door Saturday night.

“I was floored. I didn't think anything like that would happen; especially across the street from me,” said Zanghi.

“Sad, very, very sad,” said Jennifer Hageman, neighbor. “This is a very quiet neighborhood. Everyone kind of keeps to themselves so it's shocking.”

Police talked more about the investigation and said someone who knew Colantonio called police to report something was wrong. That’s when they went to her apartment Thursday.

“Detectives were able to determine that the child was born at home and that the mother, Christina Colantonia, kept the deceased infant there for a prolonged period of time,” said Todd Crosset, Batavia Police Department.

Police are not saying exactly how the infant was killed but neighbors are left with questions.

“Never any noise-- that's why I'm shocked that this happened. It's out of character for this girl,” said Zanghi.

Police say the suspect lives alone with her two other children.
