The Latest: One shot, suspect in custody after overnight shooting in Brevard

An overnight shooting in Brevard are one man in the hospital and another in custody.

Authorities tell News 13, the shooting happened just after midnight Thursday, Feb. 14, 2019, on Oakdale Street in Brevard.

Oakdale Street was closed while police were on scene conducting their investigation but the scene cleared at around 5:30 a.m.

Brevard Police Chief Phil Harris tells News 13 one person was shot and flown to Mission Hospital in Asheville where police say he was taken into surgery. Police on the scene say the victim was shot at least once in the chest. Chief Harris says when police arrived the victim was alert and talking with officers. Police say the condition of the victim is not known at this time.

The suspect, Mark Anthony Rushton, 35, of Brevard was arrested and charged with felony assault with a deadly weapon with intent to kill inflicting serious injury, misdemeanor discharging firearm inside the city limits, misdemeanor possession of marijuana and misdemeanor possession of marijuana paraphernalia.

Police say the Rushton lives at the Oakdale Street home and the victim was just visiting.

Details about what led up to the shooting have not been released at this time. Witnesses reported to police they heard at least two gunshots.

Rushton made his first court appearance on Thursday morning, where he opted for a public defender. A Transylvania County court judge informed Rushton he faces a maximum sentence of 226 months in prison for the felony charge and 20 months each for his misdemeanor charges.

Rushton is being held on a $100,000 secured bond. A probable cause hearing is set for March 7.
